About Signing Complaints 

 

YOUR RESPONSIBILITY IN SIGNING COMPLAINTS

 

You should not interpret the following statement as
one which would discourage you from signing a complaint.

 

      In signing a complaint, you are incurring a serious obligation.  The full burden of proving your complaint, beyond a reasonable doubt, will be on you, as a witness for the State, and on your witness (if applicable).  If you decide after signing your complaint, for whatever reason, you do not wish to proceed  you will be required to appear in court to explain your reasons for withdrawal.  If the Court grants your motion and dismisses the complaint, you may be subject to court costs in an amount up to $50.00. It is very important that you understand that if you FAIL to appear at a proceeding when ordered, you are subject to be charged with Contempt Of Court.

 

     When you respond to Moonachie Police Headquarters, before you sign your complaint, you will be asked to complete and sign a Moonachie Municipal Court or Teterboro Municipal Court Affidavit, depending on where your complaint originated.  The affidavit must describe the facts establishing probable cause for your complaint.  Once you complete the affidavit and sign the complaint, both are forwarded to Moonachie Municipal Court Judge P. Boggia or Teterboro Municipal Court Judge J. Brennan.  The appropriate Judge will determine whether probable cause exists to issue a summons to the person to whom you make the complaint against.  You and the person whom you make the complaint against will be notified by the Court when you are to appear.
 

Remember, both Moonachie and Teterboro Affidavits must be notarized before they will be accepted by the Court.
